CAAC Publishes the Penalties for Infractions in Relation to the Transport of Dangerous Goods by Air in 201626/05/2017

To further tighten regulation on the transport of dangerous goods by air, put in place standardized practices of transport and intensify the supervision by public opinion so as to ensure safe transport of dangerous goods by air, CAAC has recently published the penalties for 16 infractions in relation to the transport of dangerous goods by air by 12 companies, including the Silk Way West Airlines in Azerbaijan and the United Arab Emirates Etihad Airways.

CAAC recently issued a Notice on the Administrative Penalties for Infractions in Relation to the Transport of Dangerous Goods by Air in 2016 on its official website, making public, as per Article 130 of the CAAC Regulations on Transport of Dangerous Goods by Air, the administrative penalties imposed in 2016 by civil aviation authorities on the entities responsible for committing infractions with respect to the transport of dangerous goods by air.

The 12 entities listed in the Notice were known to include airlines, sales agents of freight transport and other entities that committed infractions with respect to the transport of dangerous goods by air from January 2016 to December 2016 and have been punished by relevant CAAC regional administrations. The Notice provided detailed information on the cause and basis for imposing punishment on each entity, the type of punishment, the date punishment was imposed and the administrative organs that imposed the punishment.

It’s indicated in the Notice that the penalties for the 12 entities was mainly attributable to the following: failure to transport the dangerous goods in accordance with the requirements in the permit; tendering, in violation of rules, the dangerous goods for shipment; failure to provide relevant personnel with required training on dangerous goods; and transporting dangerous goods without a permit. Depending on the severity of violations, punishments of varying degrees were imposed, which ranged from a warning to a fine of 25 000 yuan.

It is noteworthy that failure to provide relevant personnel with required training on dangerous goods led to the penalization of 8 infractions, accounting for 50% of the 16 infractions issued.
